The Uniformed Services Employment and Reemployment Rights Act (“USERRA”) was enacted to minimize the disadvantages to the civilian careers of military personnel. USERRA provides protection against discrimination and retaliation to employees based on their service in the uniformed services.

Under USERRA, protected service member employees shall not be denied initial employment, reemployment, retention in employment, promotion, or any other benefit on the basis of membership, application for membership, performance of service, application for service or obligation in the uniformed services. Where an employer take an adverse employment action against an employee based on his or her military service, USERRA provides a cause of action.

The Veterans Legal Clinic provides legal services to military personnel who have suffered an adverse employment action based on their service in the uniformed services.
